Pre-launch notice: This draft is based on GritPath's approved and working product decisions. Bracketed items and the publication checklist at the end must be resolved before this page is published. This draft requires review by qualified U.S. counsel, particularly for youth privacy, consumer protection, refunds, disclaimers, liability, and disputes.

These Terms of Use (the “Terms”) govern your access to and use of GritPath's websites, Parent Pathfinder, family account features, digital journeys, content, communications, and related services (collectively, the “Services”).

In these Terms, “GritPath,” “we,” “us,” and “our” mean [FULL LEGAL ENTITY NAME], doing business as GritPath. “You” means the adult who visits or uses the Services, creates or joins a household, purchases a product, or authorizes a youth athlete to participate.

By using the Services, creating an account, or purchasing a GritPath product, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree, do not use the Services.

1. What GritPath provides

GritPath provides educational mental-performance and sport-performance skills content for youth athletes and resources for their parents and guardians. The Services may include:

  • the public Parent Pathfinder and its provisional starting-path recommendation;
  • guardian-managed household and athlete profiles;
  • guided digital journeys, exercises, routines, and check-ins;
  • parent resources and progress summaries; and
  • related emails, reminders, and support.

The Parent Pathfinder is a sales-routing and educational tool. It may recommend a paid GritPath journey, but it also provides useful information without requiring a purchase. Its result is based on a parent's recent observations. It is not a diagnosis, a validated psychological assessment, a complete measure of an athlete, or a guarantee that a particular journey will be the best fit.

2. GritPath is not medical care, therapy, or an emergency service

GritPath teaches common performance skills involving pressure, attention, routines, mistakes, hesitation, recovery, and task-specific confidence. GritPath does not provide medical care, mental-health treatment, psychotherapy, diagnosis, injury management, crisis response, abuse or bullying investigation, eating-disorder treatment, or legal or safeguarding services.

GritPath is not a substitute for a physician, licensed mental-health professional, certified athletic trainer, school professional, sport governing body, law-enforcement agency, or emergency service. Do not rely on GritPath to monitor a child, review every response, identify an emergency, or contact help on your behalf.

If someone may be in immediate danger, contact 911 or the appropriate local emergency service. In the United States, call or text 988 for the Suicide & Crisis Lifeline. For other concerns outside GritPath's scope, seek help from an appropriately qualified professional or local authority.

3. Adult eligibility and authority

You must be at least 18 years old and legally able to enter into these Terms to create an account, create or manage a household, invite another adult, or make a purchase.

If you create or manage an athlete profile, authorize an athlete's participation, or provide information about an athlete, you represent that:

  • you are the athlete's parent or legal guardian, or otherwise have lawful authority to take that action;
  • the information you provide is accurate to the best of your knowledge;
  • you will use the Services in the athlete's best interests and in accordance with applicable law; and
  • you will obtain any additional permission required from another parent, guardian, or responsible person.

GritPath's labels “Family Organizer” and “Parent/Guardian” describe access within the Services. They do not determine custody, legal guardianship, parental rights, or authority outside GritPath. GritPath does not adjudicate family disputes. We may restrict or freeze access while reviewing a credible dispute or safety concern.

4. Youth participation

The launch version of GritPath is designed for athletes ages 8 through 17. An athlete profile is not a separate login account, and an athlete does not need an email address to participate.

The Family Organizer controls the household account and provides required product and data permissions for athlete participation. When an athlete is invited to complete an age-appropriate activity or check-in, the responsible adult must provide appropriate supervision and explain the activity in a way the athlete can understand. An athlete should not be forced to participate and should be allowed to stop an optional activity.

We may require additional notice, parental consent, youth assent, identity confirmation, or other safeguards before enabling particular youth-facing features. Direct athlete accounts, athlete-controlled email or phone destinations, and athlete-directed marketing are not part of the initial Service unless we introduce them under updated terms and privacy protections.

5. Accounts and household access

You agree to provide accurate account information, keep your credentials confidential, use reasonable security precautions, and notify us promptly at [SUPPORT EMAIL] if you suspect unauthorized access.

A Family Organizer may be able to invite another authorized adult to a household. Each invited adult must use their own account, accept these Terms and the Privacy Policy, and confirm their authority to participate. Do not share credentials or use another person's identity.

Household permissions may allow authorized adults to see athlete profile information, entitlements, schedules, and progress. Certain parent and athlete responses may be kept separate and may not be displayed verbatim to other household members. Available sharing controls may vary by feature.

6. Purchases, payments, and taxes

Prices and included features are shown before purchase. Unless a checkout page clearly says otherwise, launch GritPath journeys are one-time purchases, not automatically renewing subscriptions.

Payments are processed by Stripe or another identified payment processor. GritPath does not receive complete payment-card numbers. You authorize the payment processor to charge the amount, taxes, and other disclosed fees shown at checkout.

Each purchase provides a limited, personal, non-transferable right for the designated household and athlete to access the purchased content, subject to these Terms. An athlete-specific entitlement may not be transferred to another athlete except through an approved journey-fit or support process.

Working journey-fit and refund policy

The following policy is a pre-launch working decision and must be confirmed before publication:

  • One journey-route switch is available through the earlier of completion of Step 3 or seven days after the journey is started.
  • A refund may be requested within 14 days of purchase if fewer than three substantive journey steps have been completed.
  • If a purchased journey is clearly outside GritPath's performance-skills scope or the initial athlete check-in shows a material fit problem, GritPath may provide a refund, route switch, or other appropriate resolution.
  • Refunds are returned to the original payment method. Processing times may depend on the payment provider.
  • Nothing in this policy limits a non-waivable right available under applicable law.

To request help with a purchase, contact [SUPPORT EMAIL] with the purchasing adult's email address and order information. Do not include sensitive athlete responses in an unencrypted support email.

7. Acceptable use

You may use the Services only for lawful, personal, and family educational purposes. You may not:

  • provide false identity, authority, consent, or payment information;
  • create or manage an athlete profile without appropriate authority;
  • use the Services to harass, shame, punish, surveil, or manipulate an athlete;
  • upload unlawful, threatening, abusive, discriminatory, sexually explicit, or privacy-invasive material;
  • attempt to obtain another household's information or bypass account permissions;
  • probe, disrupt, reverse engineer, scrape, copy, or exploit the Services except where applicable law expressly permits it;
  • use automated systems to extract GritPath content, scoring, routing, or proprietary structure;
  • reproduce, sell, sublicense, publish, or commercially exploit GritPath content without written permission; or
  • use the Services to train or evaluate an artificial-intelligence model without our written permission.

We may investigate suspected misuse and restrict or terminate access when reasonably necessary to protect athletes, families, GritPath, or others.

8. Information and content you provide

You retain ownership of information and original content you submit. You grant GritPath a limited, worldwide license to host, process, reproduce, and display that material only as reasonably necessary to operate, secure, improve, and support the Services, comply with law, and fulfill the purposes described in the Privacy Policy.

You are responsible for ensuring that you have the right and authority to provide submitted information. Please do not submit information that GritPath does not request, especially medical records, detailed crisis information, custody documents, or highly sensitive information through public forms or ordinary support email.

If you voluntarily provide product feedback, you allow GritPath to use it without restriction or compensation, provided we do not publicly identify you or an athlete without permission.

9. GritPath content and intellectual property

The Services—including the GritPath and GRIT frameworks, Parent Pathfinder, scoring and routing methods, journeys, exercises, text, graphics, software, designs, trademarks, and other content—are owned by GritPath or its licensors and are protected by intellectual-property laws.

Subject to these Terms, GritPath grants you a limited, revocable, non-exclusive, non-transferable license to use purchased or freely provided content for your household's personal, noncommercial use. No ownership rights are transferred to you.

10. Third-party services and links

The Services may use or link to third-party services, including payment, hosting, communications, analytics, and support providers. Their services may be governed by separate terms and privacy policies. GritPath is not responsible for an unrelated third-party site merely because the Services link to it.

11. Changes to and availability of the Services

We may improve, modify, suspend, or discontinue features. We will use reasonable efforts to avoid materially reducing access to a paid, active journey without providing an appropriate alternative or remedy. The Services may occasionally be unavailable because of maintenance, security events, internet failures, or circumstances outside our control.

GritPath content and recommendations may evolve as we learn from research, expert review, parent feedback, and product use. We will not silently rewrite a completed Pathfinder result or historical journey record as though it used a later version.

12. Suspension and termination

You may stop using the Services at any time and may request account deletion as described in the Privacy Policy.

We may suspend or terminate access if you materially violate these Terms, misuse the Services, create risk to an athlete or another person, fail to pay an amount properly due, or expose the Services to legal or security risk. When practical, we will provide notice and an opportunity to correct the issue. Some provisions—including ownership, payment obligations, disclaimers, limitations, and dispute terms—survive termination.

13. Disclaimers

To the fullest extent permitted by law, the Services are provided “as is” and “as available.” GritPath does not promise that the Services will be uninterrupted or error-free, that a recommendation will be a perfect fit, or that participation will improve confidence, mental health, sport performance, playing time, relationships, selection, or any particular outcome.

Educational examples are general and may not fit every athlete, family, sport, coach, or situation. Adults remain responsible for decisions concerning an athlete's care, safety, training load, health, and participation.

Some jurisdictions do not allow certain warranty exclusions, so parts of this section may not apply to you.

14. Limitation of liability

To the fullest extent permitted by law, GritPath and its officers, employees, contractors, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, or opportunities, arising from or related to the Services.

To the fullest extent permitted by law, GritPath's total liability for all claims arising from or related to the Services will not exceed [APPROVED LIABILITY CAP—RECOMMENDED COUNSEL DRAFT: THE GREATER OF $100 OR THE AMOUNT YOU PAID GRITPATH DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM].

These limits do not apply where prohibited by law and do not limit liability that cannot legally be limited.

15. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold GritPath harmless from third-party claims arising from your unlawful misuse of the Services, material violation of these Terms, or knowing misrepresentation of your authority to provide information or manage an athlete profile. This obligation does not apply to the extent a claim results from GritPath's own negligence, willful misconduct, or violation of law.

16. Governing law and disputes

  • the governing state law;
  • the court venue or arbitration process, if any;
  • whether informal dispute notice is required;
  • any small-claims exception;
  • any class-action or jury-trial waiver; and
  • jurisdiction-specific consumer carve-outs.

Until this section is completed and approved, this document is not publication-ready.

17. Changes to these Terms

We may update these Terms as the Services or law changes. We will post the updated Terms and revise the “Last updated” date. If a change materially affects existing paid access, household authority, dispute rights, or how youth participate, we will provide additional notice and request renewed agreement when required.

18. General terms

If a provision of these Terms is found unenforceable, the remaining provisions remain effective. A failure to enforce a provision is not a waiver. You may not transfer these Terms or your account without our written permission. We may assign these Terms as part of a merger, financing, reorganization, or sale of the business, subject to applicable privacy and consumer-protection requirements.

These Terms, the Privacy Policy, the checkout terms presented for a purchase, and any additional terms expressly accepted for a feature form the agreement between you and GritPath concerning the Services.
